Vogel for Congress files FEC complaint against Indiana Democratic Party.
The Vogel for Congress campaign filed an FEC complaint against the Indiana Democratic Party yesterday critical of the Democratic Party's use of Mark Vogel's image on an unauthorized mailer sent just days prior to the November 2nd election. The complaint seeks an FEC ruling pertaining to the unauthorized mailer.
In the mailer, the Indiana Democratic Party endorsed Mark Vogel, the Libertarian Party candidate, for the Second District Congressional race. It was sent to approximately 20,000 voters at a cost of $15,000 according to Indiana Democratic Party Chairman Dan Parker. (ref 1) (ref 2)
According to Ray Wolff, Media Coordinator for Vogel's campaign, "We feel the regulations are clear in this case. This type of publication needs to include a disclaimer that states that the flyer was not authorized by Mark Vogel or the Vogel for Congress campaign. Members of all parties — Democratic, Libertarian and Republican — know that the Indiana Democratic Party crossed a new line with their endorsement of Vogel in this flyer. It certainly sets a bad precedent for Indiana politics."
Federal election regulations governing such publications and required disclaimers may be viewed under 2 U.S.C § 441(d)

Mark Vogel Says, "Thank You" to Over 9,400 Courageous Hoosier Voters.
The Vogel campaign is very thankful for the courage of over 9,400 voters in Indiana District 2 voting for Mark Vogel and the Libertarian Party this year. Mark believes this sends a message that an increasing number of Hoosiers are growing tired of the two Big Parties’ “Politics as Usual” in Washington and see the Libertarian Party as the solution for America's future.
When asked about Donnelly's victory, Mark commented, "It was a great race and the voters have made their decision. I certainly wish Joe the best in representing all of us here in District 2 for the next two years. We hope Congressman Donnelly will live up to his role as being the representative for the people he represents here in Indiana and not just the Democratic party. A majority of the voters did not vote for the messages of either party. I hope Joe considers this fact in every one of his decisions as Congressman."
Regarding the role and affect of Mark's affect on the outcome, Mark said, "I really don't believe there was the effect that many might wish to believe. As the Libertarian candidate, my positions on NAFTA, bringing the troops home, ending the war on drugs, smaller government, ending the federal reserve and lower taxes is a message that appealed to voters whose views were not being represented by the other two candidates. People who voted for me, simply were not being represented by the other two candidates or their parties. I am happy that I afforded these 9,400 courageous voters a voice and option in this election."

Vogel Campaign to Explore FEC Complaint Regarding Recent Indiana Democratic Party Mailer
The Vogel campaign is to explore the possibility that the Indiana Democratic Party violated federal election laws in its recent mailer regarding Mark Vogel. The mailer which was not discussed or authorized by Mark Vogel or his campaign was mailed to as many as 20,000 Hoosier voters at a cost of $15,000 in the IN District-2 race.
Mark commented, "This is not something I necessarily wanted to be pulled into. Both the Democrats and Republicans have made campaign laws so complicated and favorable to big campaigns, that they make it almost impossible for ordinary citizens like me to run for office. If the two parties cannot understand and follow the very rules they set, how can anyone else? I only agreed to explore the FEC complaint filing for the benefit of the 'Average' American Joe, not the ‘Big Money Backed’ Joe."
Combined, the Walorski and Donnelly campaigns have spent more than $2.32 Million on this year’s congressional campaign. Mark commented, "This kind of money could have benefited a lot of Hoosier families that really need help in this economy. The Indiana Democrats spent $15,000 on a mailer regarding my campaign, the Libertarian candidate! It may or may not benefit my campaign, however, it really shows how both the Republicans and Democrats are out of touch with the needs and suffering of Hoosier voters. I hope this give voters just one more reason to vote Libertarian."
When asked regarding the motives of the Democratic flyer, "What were their motives for this mailer? I will leave this up to the Indiana Democratic Party to explain to its own members and the Hoosier voter to decide."
Mark Vogel is a 10 year veteran of both the U.S. Navy and U.S. Air Force Reserves and honored to have taken the oath to defend the U.S. Constitution against all enemies, foreign and domestic. Mark is currently completing his Doctor of Pharmacy degree through Purdue University and also became the proud new father of Mark Vogel Jr. born this past June.

PRESS RELEASE
****FOR IMMEDIATE RELEASE***
October 31, 2010
Many Indiana District 2 voters are receiving a mailer from the Indiana Democratic Party showing support for Libertarian Candidate Mark Vogel. The flyer, which was a pleasant surprise today for the Vogel campaign, highlights Libertarian Mark Vogel’s support of the 2nd amendment, lower spending, and less taxes.
As Mark Vogel first said in receiving a copy of the flyer, “It is great to see that the Democratic Party of Indiana is finally for Real Change and sound candidates that support Constitutional government, lower spending and free markets; something the Democratic party has not believed in for many decades.”
When asked about the flyer depicting Libertarian Mark Vogel as the only true conservative in the race, Mark Vogel commented, “Conservative? I don’t use terms like conservative and liberal. I am only what most people term ‘conservative’ when it comes to our Nation’s fiscal matters. I am a Libertarian through and through which is much different and more than being a conservative. My positions on less military spending, non-interventionist foreign policy, repeal of NAFTA and human rights makes me a candidate that liberal and conservative citizens can vote for. I hope people will continue to check out the Libertarian Party and see that our policies and candidates offer something better for Americans.”
In a surprise to the Vogel campaign, the flyer was sent without the knowledge or consent of Mark Vogel or the Libertarian Party. As Mark stated, “This is simply incredible for me and my campaign. Having the Indiana Democratic Party support me, the Libertarian candidate over their candidate is phenomenal! One couldn’t make this stuff up, if didn’t actually happen!”
Regarding the endorsement of Mark Vogel by the Indiana Democratic Party, “It really doesn’t come as much of a surprise. Throughout the campaign, Congressman Joe Donnelly has repeatedly stated that he is an Independent and not a part of the Pelosi and Democratic team. It is great to see the Democrats finally in support of Libertarian beliefs. It will be the only way for us to truly get out of the mess that both Democrats and Republicans have created for Americans. I urge ALL Americans to vote Libertarian this year!”
In Mark’s final comments on the flyer, “I got into this race because of the childish antics by both the Republican and Democratic Parties. The choices the two parties give America typically boil to two grown adults acting like preschoolers in a sandbox fighting over the sand bucket! I am just happy that the Libertarian Party offers voters a third mature option this November.
Mark jokingly stated, "I can now only hope the Republicans will put out a flyer saying that I am the best Liberal Candidate!”
